These Terms of Sale apply to purchases made through getnexgenware.com.

The store is operated by WORTHAM NEXGENWARE SYSTEMS LLC.

By submitting an order, you agree to these Terms of Sale and the other policies published on our website.

Products and Availability

Products are offered subject to availability.

We may:

Limit purchase quantities;
Discontinue products;
Update product specifications;
Correct errors in product descriptions, photographs or prices; and
Cancel an affected order, subject to applicable law.

Product dimensions, weights and colors may vary slightly within normal manufacturing, measurement or display tolerances.

Compatibility and Intended Use

Customers are responsible for reviewing all applicable product information before ordering, including:

Product dimensions;
Supported device sizes;
Weight limits;
VESA mounting patterns;
Port and cable standards;
Operating-system requirements;
Desk-thickness requirements; and
Installation instructions.

Products must be assembled, installed and used according to the supplied instructions, stated limitations and applicable safety warnings.

Order Acceptance

Submitting an order does not guarantee its acceptance.

We may decline or cancel an order because of:

Payment failure;
Suspected fraud or unauthorized activity;
Inventory errors;
Shipping restrictions;
Incorrect customer information;
Obvious pricing mistakes; or
Another legitimate operational or security reason.

If payment has already been captured for an order that we cancel, the amount will be refunded to the original payment method.

Prices, Taxes and Payment

Prices are displayed in U.S. dollars unless otherwise stated during checkout.

Applicable sales tax and any optional expedited shipping charge will be calculated and displayed before the order is submitted.

We accept Visa and Mastercard through Shopify Payments.

Shipping and Delivery

Order-processing periods, transit estimates, shipping charges and delivery conditions are described in our Shipping Policy.

Delivery times are estimates and are not guaranteed. Delays may occur because of weather, carrier disruptions, holidays, address problems or other circumstances outside our reasonable control.

Returns and Refunds

Returns and refunds are governed by our Refund Policy.

Eligible products may be returned within 30 calendar days after delivery. Returns must be authorized before they are mailed.

No restocking fee is charged for eligible returns.

Risk of Loss

Ownership and risk of loss pass according to applicable law and carrier delivery records, subject to mandatory consumer rights.

If tracking shows delivery but the package cannot be located, contact the shipping carrier and our customer support team promptly.

12-Month Limited Warranty

Eligible getnexgenware products are covered by a 12-month limited warranty beginning on the original delivery date.

The warranty covers confirmed defects in materials or workmanship arising during normal intended use.

Warranty Exclusions

The limited warranty does not cover:

Ordinary wear;
Cosmetic changes that do not affect product function;
Accidental damage;
Misuse or abuse;
Unauthorized modification or repair;
Improper assembly or installation;
Use beyond stated weight or compatibility limits;
Incompatible devices or equipment;
Liquid damage;
Loss or theft; or
Damage caused by external events.

Warranty Claims

To request warranty service, contact us with:

Your order number;
A description of the problem;
Clear photographs or video; and
Any other information reasonably requested by our support team.

We may require troubleshooting or inspection of the returned product.

For an approved claim, we may repair, replace or refund the affected product at our reasonable option, subject to applicable law.

Replacement products or components are covered for the remainder of the original warranty period or any longer period required by law.

Limitation of Warranty

To the extent permitted by law, this limited warranty is the exclusive written product warranty provided by us.

Nothing in these Terms excludes or reduces consumer rights that cannot legally be waived.

Limitation of Liability

To the fullest extent permitted by law, WORTHAM NEXGENWARE SYSTEMS LLC will not be liable for indirect, incidental, special, consequential or punitive damages relating to a product or purchase.

Our total liability relating to a product will not exceed the amount paid for that product.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
